Striver Architecture Assessment™ (SAA™)

Workhorse Consulting LLC d/b/a Strive Better ("Strive Better," "we," "us," or "our") operates the Striver Architecture Assessment™ ("SAA™" or the "Service"). By creating an account, accessing, or using the Service, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Nature of the Service

The Service is provided for educational and reflective purposes only. It does not constitute medical, psychological, psychiatric, legal, financial, or professional advice, and it is not a clinical diagnostic instrument.

You are solely responsible for how you interpret and apply your results. If you have concerns about your mental or physical health, seek guidance from a qualified professional.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that the information you provide is accurate to the best of your knowledge.

3. Account Registration and Security

Access to the Service may require account registration. You agree to maintain the confidentiality of your login credentials and to notify us promptly of any unauthorized use of your account. You are responsible for all activity that occurs under your account.

4. Acceptable Use

You will not attempt to disrupt, hack, reverse-engineer, or misuse the Service.
You will not use automated systems (including bots, scrapers, or crawlers) to access or extract data from the Service.
You will not copy, reproduce, distribute, publish, publicly display, or commercially exploit any portion of the Service, including the assessment items, item structure, scoring logic, classifications, or written interpretations, without our prior written authorization.
You will not compile, aggregate, or use the assessment items or outputs to create a dataset, train or evaluate machine learning models, benchmark competing products, or develop a competing or substantially similar assessment.
You will not represent the Service as a licensed psychological evaluation or clinical diagnosis.

5. Proprietary and Confidential Materials

The Service contains proprietary content and materials owned by Strive Better, including the SAA™ framework, assessment items, structure, scoring framework, classifications, reports, written interpretations, and related documentation (collectively, "Proprietary Materials"). Except as expressly permitted under these Terms, you agree not to disclose, share, or make available the Proprietary Materials to any third party.

6. Intellectual Property and Limited License

The SAA™ and all Proprietary Materials are protected by intellectual property laws and remain the exclusive property of Strive Better and/or its licensors. No ownership rights are transferred to you.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access the Service for your personal, non-commercial use and to view your own results. No other rights are granted.

7. No Professional Relationship

Completion of the assessment does not create a therapeutic, medical, or fiduciary relationship. If you complete the assessment within a coaching engagement, that relationship is governed separately by the applicable coaching agreement.

8. Termination

We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms or misused the Service. Sections intended to survive termination (including intellectual property, proprietary materials, disclaimers, limitation of liability, and governing law) will survive.

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Service. Our total liability for any claim shall not exceed the amount you paid for access to the Service, if any, during the twelve (12) months preceding the event giving rise to the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available." We make no warranties, express or implied, regarding accuracy, reliability, completeness, or fitness for a particular purpose.

11. Privacy

Your use of the Service is also subject to our Privacy Policy. By using the Service, you consent to our collection and use of information as described in the Privacy Policy.

12. Governing Law

These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict of law principles.

13. Updates

We may update these Terms periodically. The "Last Updated" date above indicates when these Terms were last revised. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
